I’d say it’s a gray area where the devices would be half-way tolerated as long as the actual use didn’t hurt profits (or did so only in a very marginal manner). But if that changed, I’m not so sure that they would have to be marketed as theft devices to get in trouble. Other evidence would be considered as well, if it ever came to a DMCA lawsuit. For instance, let’s say an F2P publisher introduces countermeasures in a game to prevent currency-stealing codes from working, and those are circumvented by an updated version of the cheat device.
